Review (Status: Rejected)

Dear Apple Team,

Thank you for your submission feedback.

At Talk 2 Duck Limited we take pride in our software and delivering it to the highest standards.
We were sad to hear about recent rejection of publication of Hue Temperature to the AppStore and worked hard to rectify highlighted issues.

We hope that the evidence provided below is satisfactory to progress publishing of Hue Temperature application.

Issue 1: Hue Temperature cannot be tested (Guideline 2.1 - Information Needed)
Resolution:
Since Hue Temperature application requires Philips Hue Bridge, we have attached a test video (also available at https://www.talk2duck.com/hue-temperature-release-v1-0-0) of application connecting to Philips Hue Bridge and showing all the functionality.

Issue 2: Hue Temperature includes copyrighted assets and unauthorised wording of Philips Hue Bridge (Guideline 5.2.1 - Legal - Intellectual Property)
Resolution:
We have corrected Content Rights clause for Hue Temperature app to accept that Talk 2 Duck Limited has all the necessary rights to third party content used in the app. Please note that Talk 2 Duck Limited is registered with Philips Hue Developer programme and that Hue Temperature uses all official assets and APIs provided by Philips brand through Signify Holdings, and has been designed in line with Hue Application Design Guidelines (available for registered users at https://developers.meethue.com/develop/application-design-guidance).

Hue Temperature uses the following:
- Official Philips Hue Icon Pack (available for registered users at https://developers.meethue.com/develop/application-design-guidance/icon-pack)
- Official Philips Hue API (available for registered users at https://developers.meethue.com/develop/hue-api)

Please find below the extract from Hue API Overview (available for registered users at https://developers.meethue.com/develop/hue-api) supporting authorised use of 'hue' and 'Philips' references in Hue Temperature application.

Philips has a quite progressive policy with hue. As you are free to create with our product, we think it should also be you who profits from your work. What you produce you own and are free to give away or sell. There’s a little catch – this also means that everything connected with use of your product is your responsibility. Philips will not accept liability if your product causes harm, for example. So use your powers for good!
And, it’s up to you whether and on what terms you choose to commercialize your product. So while we say “what is yours is yours”, on the flip side we also say, “what is ours is ours”. Here, we mean the software, trademarks documentation, and any other materials we provide to help you develop hue apps.
For example, you may refer to “hue” and “Philips” in plain text but you aren’t allowed to use “hue” or “Philips” branding in any logo or graphics. Also important to note is that the interface specifications “API” belong to Philips. Imagine you are working on an app and you come up with a brilliant idea for an improvement in the API or our materials. If you suggest any improvements to us and we adopt them, they become part of the platform used by everyone, and will belong to us.

Please let us know if our interpretation of rejection reasons is correct and if there are any outstanding issues preventing Hue Temperature app to be published.

Kind Regards,
Talk 2 Duck Team
